- • We are seeking a highly motivated and skilled Product, Privacy and Data Protection Counsel to become an integral part of our esteemed Legal team. This role is designed for an attorney who thrives on tackling complex challenges and is eager to contribute to a forward-thinking legal and compliance function. You will collaborate closely with Real’s product and engineering departments, offering expert legal counsel on a diverse array of legal matters. A significant focus will be placed on privacy and data security, particularly as they relate to the entire product development lifecycle. This position is crucial for navigating the intricate regulatory landscape of a fintech company, which exerts a broad market influence within an ever-evolving and complex financial legal and regulatory environment.
- • Our Legal team plays a pivotal role in enabling our internal partners to develop and refine our technological initiatives with an unwavering commitment to speed, precision, and exceptional quality in execution. This is a fully remote position, offering flexibility and the opportunity to work from anywhere within the U.S.
- • In this capacity, you will provide comprehensive legal guidance to our Product, Marketing, and various business teams throughout every stage of the product lifecycle. This includes advising on all applicable legal and regulatory requirements and potential risks, ensuring that our products and services meet the highest standards of compliance.
- • A key responsibility will be to proactively anticipate and identify potential legal and regulatory risks. You will be instrumental in devising creative, practical, and effective solutions to mitigate these risks, always maintaining a business-focused mindset that prioritizes achievable outcomes.
- • You will also be responsible for drafting and negotiating a variety of commercial agreements that are essential for supporting the business operations and its strategic initiatives. This includes vendor agreements, partnership agreements, and other critical contracts.
- • Staying abreast of the latest developments in relevant industry and consumer protection laws and regulations is paramount. This includes, but is not limited to, laws affecting the real estate and fintech sectors, ensuring Real remains compliant and ahead of the curve.
- • You will work in close partnership with our Marketing and go-to-market teams to meticulously review and ensure the full compliance of all consumer-facing materials. This guarantees that our external communications are accurate, transparent, and legally sound.
- • Furthermore, you will collaborate with the broader Legal & Compliance team on a range of other corporate and enterprise-wide initiatives. This cross-functional collaboration ensures a holistic approach to legal and compliance matters across the organization.
- • This role demands a deep understanding and practical application of consumer protection laws and regulations pertinent to our industry, such as the Real Estate Settlement Procedures Act (RESPA), the Unfair, Deceptive, or Abusive Acts or Practices (UDAAP) regulations, and the Gramm-Leach-Bliley Act (GLBA). Your expertise will be vital in ensuring adherence to these critical statutes.
- • A fundamental requirement for this position is a genuine willingness and eagerness to delve into and master new technologies. This role necessitates a high degree of digital fluency, or at the very least, a strong aptitude and commitment to rapidly acquiring such fluency. Your ability to understand and apply legal principles to innovative technological solutions will be a key differentiator.
🎯 Requirements
- • Juris Doctor (JD) degree from an accredited law school and admission to at least one state bar.
- • Minimum of 7 years of experience as a Product Counsel, either in a law firm setting or an in-house legal department, with a strong emphasis on technology and product development.
- • Proven experience working within a law firm or in-house corporate environment specifically on regulatory compliance matters, particularly within the fintech or real estate sectors.
- • In-depth knowledge and practical application of consumer protection laws and regulations such as RESPA, UDAAP, and GLBA.
- • Demonstrated ability to anticipate and identify legal and regulatory risks, and to propose creative and effective business-focused solutions.
- • High proficiency in Microsoft Office programs (Outlook, PowerPoint, Word, Excel) and a strong aptitude for learning new technologies.
