Full Job Description

📋 Description

  • • Step into the role of Senior Counsel, Ethics & Employment at Affirm and become the guardian of our “no fine print” promise while we reinvent consumer credit for millions. Reporting to the General Counsel and working fully remote, you will be the single point of accountability for all ethics, compliance, and employment-law matters across North America, APAC, and EMEA, ensuring that every policy we publish and every practice we adopt reflects our core value of honesty.
  • • Own the entire employment-law lifecycle—from drafting offer letters, equity grants, and restrictive covenants to negotiating executive separations and contingent-worker agreements—while supporting a workforce that has tripled in three years and continues to scale globally.
  • • Architect and continuously evolve Affirm’s global Code of Conduct, anti-harassment, anti-discrimination, and whistle-blower programs; translate dense regulatory language into clear, human-centric guidance that every employee, contractor, and board member can understand and champion.
  • • Partner cross-functionally with People Operations, Internal Audit, Security, and Product teams to conduct proactive risk assessments, root-cause analyses, and corrective-action plans that turn potential issues into measurable competitive advantages.
  • • Lead privileged internal investigations from intake to closure, and respond to EEOC, DOL, OSHA, and state-agency charges with speed, empathy, and airtight documentation that protects both our people and our reputation.
  • • Counsel executives, managers, and People Partners on sensitive performance, accommodation, leave, and pay-equity issues, translating complex legal nuance into actionable, values-aligned guidance that drives fair outcomes.
  • • Draft and negotiate executive employment agreements, separation agreements, and settlement releases that balance aggressive business objectives with Affirm’s unwavering commitment to transparency and fairness.
  • • Build and deliver scalable training curricula—live, virtual, and micro-learning—that drive measurable increases in ethical decision-making and reduce incident rates year over year.
  • • Monitor and interpret evolving federal, state, and local employment legislation—including wage-and-hour, privacy, AI-recruiting, and pay-transparency laws—and translate changes into clear policy updates and system configurations that keep us ahead of the curve.
  • • Represent Affirm externally with regulators, industry groups, and diversity-focused organizations, positioning the company as a thought leader in ethical fintech employment practices.
  • • Champion data-driven decision making by building dashboards that track investigation metrics, policy exceptions, and training effectiveness, enabling the business to spot trends before they become liabilities.
  • • Collaborate with the broader Legal team on M&A due diligence, integration planning, and post-close employment harmonization to ensure seamless cultural and legal alignment.
  • • Mentor junior attorneys and paralegals, fostering a culture of curiosity, inclusion, and continuous improvement across the global legal function.
  • • Contribute to Affirm’s public-facing ESG and DEI reports by providing accurate, defensible data and narratives that showcase our ethical leadership to investors, consumers, and regulators.
  • • Thrive in a fully remote environment that prizes asynchronous communication, transparent documentation, and outcomes over hours—while still finding time for virtual coffee chats and global off-sites that keep our culture vibrant and connected.
