- • Serve as the primary legal counsel for OpenAI’s marketing organization, providing expert guidance on all marketing-related legal matters across digital, print, social, influencer, email, events, and other channels.
- • Partner directly with marketing, brand, communications, product marketing, growth, creative, and performance teams to support campaigns, product launches, brand initiatives, and global events while ensuring legal compliance.
- • Review, advise on, and approve marketing claims, campaign materials, creative concepts, and promotional assets to align with advertising, consumer protection, endorsement, and disclosure standards.
- • Address complex legal issues related to FTC regulations, state UDAP laws, CAN-SPAM, TCPA, and EU/UK marketing compliance standards, ensuring global adherence to regional legal requirements.
- • Develop scalable, practical legal frameworks and processes to enable fast-moving marketing teams to innovate while managing risk effectively.
- • Provide strategic legal input on influencer partnerships, contests, promotions, and user-generated content initiatives to mitigate regulatory exposure.
- • Collaborate with privacy, IP, and data security teams to ensure marketing activities comply with data protection laws and intellectual property rights.
- • Evaluate and mitigate legal risks associated with brand messaging, comparative advertising, product claims, and performance marketing metrics.
- • Draft, negotiate, and review third-party agreements including vendor contracts, influencer agreements, sponsorship deals, and event partnerships.
- • Translate complex legal requirements into clear, business-friendly guidance that empowers marketing teams to act decisively without compromising compliance.
- • Build and maintain strong cross-functional relationships with non-legal teams by communicating in a manner that resonates with creative, fast-paced marketing cultures.
- • Proactively identify emerging legal trends in AI-driven marketing and adapt policies to address new challenges posed by generative AI, automated content, and personalized advertising.
- • Maintain up-to-date knowledge of evolving global marketing regulations and ensure OpenAI’s marketing practices remain legally defensible and industry-leading.
- • Demonstrate sound judgment in ambiguous situations, balancing innovation and creativity with legal responsibility in a high-stakes, rapidly evolving AI environment.
- • Own legal strategy for marketing initiatives from concept through execution, serving as a trusted advisor who enables business growth while safeguarding the company’s reputation.
- • Contribute to the development of internal training and resources to educate marketing teams on legal best practices and compliance obligations.
- • Work closely with external counsel and internal stakeholders to coordinate legal responses to regulatory inquiries, consumer complaints, or enforcement actions related to marketing activities.
- • Ensure all marketing materials comply with OpenAI’s ethical standards and mission to ensure AI benefits all of humanity.
🎯 Requirements
- • 10+ years of experience combining in-house and technology-focused law firm roles
- • Juris Doctor (JD) and active license or qualification to practice law in California
- • Demonstrated expertise in advertising, consumer protection, endorsements, promotions, privacy, and marketing-related regulations (FTC, UDAP, CAN-SPAM, TCPA, EU/UK standards)
- • Proven ability to partner with creative, fast-paced marketing and brand teams
- • Experience building scalable legal processes for high-growth technology organizations
- • Strong judgment in ambiguous situations with a practical, business-oriented approach to legal risk
