📋 Description

• Serve as the legal authority on the lifecycle of financial instruments, including stocks, investment funds, bonds, and derivatives, ensuring compliance is embedded into product design from inception.
• Partner directly with Product and Engineering teams to translate complex financial regulations — including MiFID II/III, WpIG, WpHG, and MaRisk — into concrete technical requirements for API features such as fractional trading and new asset classes.
• Own the legal adaptation of Upvest’s core German investment offering as it expands into the UK, Switzerland, and broader EEA markets, defining jurisdiction-specific regulatory requirements while maintaining a scalable, unified product framework.
• Act as the primary internal expert on EU and German financial regulation, monitoring regulatory developments and translating their implications into actionable guidance for Product, Operations, and Compliance teams.
• Lead and support the negotiation of complex B2B agreements with institutional counterparties, including credit institutions and major fintechs such as Revolut, N26, and DKB.
• Drive the modernization of the legal function by championing the adoption of contract lifecycle management tools, AI-assisted review workflows, and automated processes to increase efficiency and free capacity for strategic legal work.
• Provide clear, pragmatic legal advice that enables commercial decision-making without creating operational bottlenecks, balancing risk mitigation with business growth objectives.
• Ensure legal robustness, commercial competitiveness, and technical precision across Upvest’s Investment API as it scales internationally across multiple regulatory regimes.
• Collaborate cross-functionally as a trusted adviser to Product, Engineering, Operations, and Compliance, delivering actionable legal insights that align with Upvest’s mission to make investing as easy as spending.
• Contribute to the development of scalable, cross-border legal infrastructure that supports Upvest’s rapid international expansion and positions the company as a leader in European fintech investment products.
• Maintain professional fluency in both German and English to manage regulatory filings, stakeholder communications, and high-stakes negotiations across jurisdictions.
• Advocate for legal automation and technology-driven process improvements to enhance scalability, reduce manual workload, and improve accuracy in legal operations.
• Support the legal team in maintaining compliance with evolving regulatory standards across MiFID, WpIG, WpHG, MaRisk, and relevant UK FCA requirements.
• Ensure legal frameworks remain adaptable to new asset classes and product innovations while preserving regulatory integrity and operational efficiency.
• Participate in shaping Upvest’s legal strategy as the company scales following its €105M funding round, enabling the expansion of investment product offerings across Europe.

🎯 Requirements

• At least 3–5 years post-qualification experience (PQE) in the financial services industry
• At least one German legal qualification (Erste Juristische Prüfung)
• Hands-on understanding of investment product lifecycles (stocks, funds, bonds, derivatives) as a seasoned practitioner
• Strong command of EU and German financial law (MiFID, WpIG, WpHG)
• Professional fluency in both English and German
• Experience in a regulated investment firm, fintech, infrastructure provider, or bank with brokerage and custody product offerings
