📋 Description
- • Lead Dave’s litigation and adversarial regulatory response function, overseeing consumer litigation, class actions, arbitrations, regulatory investigations, enforcement actions, and complex disputes as the company scales.
- • Develop and implement scalable processes for litigation holds, discovery, document management, and regulatory response coordination to ensure compliance and efficiency across high-volume legal matters.
- • Partner with outside counsel to define defense strategies, oversee case management, manage legal budgets, and ensure delivery of high-quality legal work product in time-sensitive, high-stakes matters.
- • Advise executive leadership and the Board on litigation and regulatory developments, risk exposure, settlement strategy, and potential business impact across Dave’s financial products and operations.
- • Collaborate with Compliance, Product, Risk, and Operations teams to proactively identify, assess, and mitigate litigation and enforcement risks tied to Dave’s flagship ExtraCash product and upcoming offerings like BNPL.
- • Shape Dave’s long-term legal strategy by building systems and frameworks that adapt to evolving regulatory environments and support sustainable growth without compromising member trust.
- • Serve as the primary legal liaison on adversarial matters, ensuring alignment between legal outcomes and business objectives while maintaining Dave’s mission of affordable, transparent financial access.
- • Manage and mentor a growing litigation and regulatory enforcement team, establishing performance standards, career development paths, and operational protocols to support future expansion.
- • Present complex legal and regulatory issues to senior leadership and the Board with clarity, precision, and strategic context, enabling informed decision-making under uncertainty.
- • Maintain deep expertise in consumer financial services laws including TILA, TISA, EFTA, FCRA, GLBA, UDAAP, ROSCA, and state consumer protection statutes to guide product design and compliance.
- • Balance legal rigor with business pragmatism, making sound judgments on risk tolerance, settlement trade-offs, and operational feasibility in dynamic fintech environments.
- • Influence cross-functional teams to embed legal risk considerations early in product development, operations, and customer experience design to prevent avoidable litigation and regulatory exposure.
- • Ensure Dave’s legal function operates with integrity, transparency, and member-centricity, aligning all adversarial responses with the company’s mission to serve financially vulnerable populations.
- • Maintain active awareness of regulatory trends from the CFPB, FTC, SEC, OCC, FRB, FDIC, state attorneys general, and state financial regulators to anticipate and respond to emerging enforcement priorities.
🎯 Requirements
- • J.D. from an accredited law school and active bar membership in good standing
- • 12+ years of legal experience with significant focus on consumer financial services litigation and regulatory matters
- • Demonstrated experience managing complex litigation including class actions, arbitrations, discovery, motion practice, and trial strategy
- • Proven experience handling regulatory inquiries and enforcement actions from agencies such as CFPB, FTC, SEC, OCC, FRB, FDIC, state attorneys general, and state financial regulators
- • Strong knowledge of consumer financial services laws including TILA, TISA, EFTA, FCRA, GLBA, UDAAP, ROSCA, and related state consumer protection statutes
- • Experience partnering closely with cross-functional teams including Product, Operations, Compliance, and executive leadership
